What Is a Guardianship?

A guardianship — which grants rights similar to those of a power of attorney — allows an individual, usually a family member, to be appointed a guardian in order to make important decisions for a loved one who no longer has the faculties to make these decisions or care for himself or herself.

In cases involving guardians being appointed for minors, the guardianship can be contested by other family members who disagree with the decision being in the best interest of the minor. Terminating Guardianships

In situations where a guardianship has been established for a child, a parent may resolve the issues that led to the original guardianship and seek to have the guardianship terminated and his or her rights restored. Having a guardianship terminated is often a long, complex process; this is by design as it is very difficult to get a guardianship over a natural parent who is able and willing to care for his or her child and make decisions about his or her well-being.
