Alternatives to A Divorce in Illinois

When an Illinois couple gets married, they understandably assume their marriage will last forever. Unfortunately, sometimes marriage is not destined for eternity. Besides the traditional divorce, there are two other alternatives to a divorce in Illinois.

Some couples who decide they can no longer be married may look to alternatives from a traditional divorce. In Illinois, there are two alternatives to divorce. One is an annulment. There are certain grounds a marriage must meet before an annulment is granted. These include alcohol, drugs, infirmity, underage, inability to consummate, or a prohibited marriage. There are certain time limits that need to be met in order for an annulment to be granted. The second alternative to a standard divorce is a legal separation. A legal separation works for couples who don’t want to divorce but want to live separately but need to clarify legal matters such as child custody and property division. Although the marriage is not technically over and a person cannot legally get remarried, a legal separation can do many of the same things that a divorce can do.

Not all marriages are the same which is why divorces in Illinois are unique as well. A legal professional who is skilled in family law can help their client determine what options can be best for their situation. They can advise their client on matters including child support, property division, spousal support, and other important subjects. A traditional divorce may not be the right move for a couple who no longer wants to be married and there are different options for these couples in Illinois. An attorney can make sure their client’s legal rights are protected and that their divorce or separation goes as planned.

Illinois couples who no longer want to be married have a few options besides a traditional divorce. These alternatives to a divorce may be attractive for some couples.
